This fifth application under Section 439 of Cr.P.C. has been filed for grant of bail. The fourth application was dismissed by order dated 29.6.2021 passed in M.Cr.C.No.31852/2021.
The applicant has been arrested on 11.2.2021 in connection with Crime No.310/2020 registered at Police Station Piprai, District Ashoknagar for offence under Section 306, 34 of IPC.
It is submitted by the counsel for the applicant that this repeat application has been filed purely on the ground of period of custody.
Heard the learned counsel for the applicant.
By order dated 29.6.2021 passed in M.Cr.C.No.31852/2021, this Court had found that after rejection of previous bail application on merits by order dated 10.3.2021 passed in M.Cr.No.12199/2021, the applicant immediately obtained the affidavits of the witnesses which were executed subsequent to the rejection of second bail application and filed the repeat bail application along with the affidavits of the witnesses to project that they would not support the prosecution case.
Thus it is clear that although the applicant is in jail but with the help of his Pairokar and well-wishers he is pressurizing the witnesses and under these circumstances, no sympathetic view can be taken in the matter.
Accordingly, the application fails and is hereby dismissed.
