Judgment
This is an application by the respondent-applicant for recording payment of the remaining part of the alimony which was assessed by this court at Rs.3,00,000/-.
There is no dispute that on 02.06.2020, out of Rs.3,00,000/-, a sum of Rs.2,00,000/- was paid to the appellant-respondent by a bankers cheque.
This application has been filed to seek leave to deposit the remainder amount i.e. Rs.1,00,000/-. The same has been paid in the proceeding to the appellant-respondent by a banker's cheque bearing number 900626 dated 26.06.2020.
Mr. D.C. Roy, learned counsel has acknowledged the receipt of the said banker's cheque by putting a note in the file of MAT App. No. 03 of 2016 appearing for the appellant-respondent.
It has been asserted in the application that all the articles belonging to the appellant-respondent have been returned.
Therefore, the respondent applicant does not have any further obligation to discharge.
Having noted this, the Registry is directed to issue the decree in terms of the judgment dated 04.03.2020.
The delay in payment is condoned by us.
With this observation, this interlocutory application for direction stands disposed of.
