Sumitra Devi and another vs State of H.P. and others

Justice Kurian Joseph, C.J.—The writ petition has been filed with the following prayer:

(i) To direct the respondents No. 3 and 4 to grant permission to the petitioners for carrying out their own old timber which has been stocked from the old house after dismantling the same at Kupvi to bring to Shimla for use in their newly constructed three storey building in Dhalli area at Shimla as already represented vide Annexure P7 and P8.

The learned Deputy Advocate General submits that 3d respondent/competent authority may be directed to look into the matter and take appropriate action in accordance with the Rules/guidelines in the matter. Therefore, the writ petition is disposed of directing the petitioner to furnish the list of each of the timber items alongwith its dimension/measurement details to the 3rd respondent for its spot verification by the competent authority. The 3rd respondent/competent authority shall take appropriate action on the representation filed by the petitioner, in accordance with the Rules/ Guidelines/ instructions issued this regard, within a period of one month from the date of production of the copy of this judgment before the 3rd respondent.
