This petition seeks transfer of HMA 2356/2023 (Gaurav Rastogi v. Sumita Rastogi), presently pending before the Family Court in the Karkardooma District Courts to the Family Court in the Saket District Courts, South District.
It is not disputed that there are other cognate litigations between the parties pending before the Saket District Court.
Mr. Panjwani, learned Counsel for the respondent leaves the matter to the Court but prays that the proceedings, if transferred, may be directed to continue from the stage at which they are at present.
It goes without saying that if all interconnected proceedings between the same parties are decided by one Court, the interests of ensuring expeditious dispensation of justice would be greatly facilitated.
Accordingly, the Transfer Petition is allowed.
HMA 2356/2023 (Gaurav Rastogi v. Sumita Rastogi) is transferred from the Family Court, Karkardooma District Courts to the competent Court in the Saket District Courts, South District. Let the papers be placed before the Principal District Judge of the Saket District Court for allocation to the appropriate Court.
The matter would be listed before the appropriate Court in the Saket District Court on 5 April 2024.
The date of 26 March 2024 presently fixed shall stand cancelled.
The Registry of the Karkardooma District Court is directed to take expeditious steps to transmit the record to the Saket District Court for compliance with this order.
The petition is disposed of in the aforesaid terms.
