Judgment
Police report stands filed. Today, when the matter was taken up for consideration, learned Law Officer states that the case is now listed before the learned trial Court on 12.01.2018, for recording the statement of the accused, under Section 313 Cr. P.C. On the other hand, learned counsel for the petitioner states that the case before the learned trial Court is lingering since 16.01.2017. He further states that the learned trial Court may be directed to dispose of the matter at the earliest and at this moment, he may be allowed to withdraw the present petition, with liberty reserved to approach competent Court of law, as and when required.
In view of the above, the petition is dismissed, as withdrawn with liberty reserved to the petitioner to approach competent Court of law, as and when he so desires.
However, taking into consideration the overall aspects of the case and the fact that the matter is pending as stated by the learned counsel for the petitioner for recording the statement of the accused for last one year and the petitioner is behind the bars since long, it is expected that the learned trial Court will try to dispose of the matter at the earliest possible.
The petition, as also pending application(s), if any, shall stand(s) disposed of.
