Ms. Modi, learned advocate appears on behalf of petitioner and submits, her client is seeking correction of his surname, as appearing in the School Leaving Certificate (SLC). This is preventing the Board from causing corresponding correction.

Ms. Pattanayak, learned advocate, Additional Government Advocate appears on behalf of State and submits, this Bench does not have assignment. It is a residuary matter.

Mr. Dash, learned advocate appears on behalf of the Board. He relies on regulation 40 in Regulations of the Board of Secondary Education, Orissa notified on 22nd December, 1955 and subsequent orders issued from time to time.

Assignment entry no.4 of this Bench is ‘writ petitions regarding issuance of caste certificates and other certificates’. The contention is, the certificate was issued with a mistake. Petitioner seeks a correction. This Bench has assignment.

Petitioner made representation dated 25th October, 2016 to the Head Master for making the correction. His surname is ‘Dhrua’. Mistakenly it was mentioned as ‘Dharua’ on interpreting the name and writing it in Odia. The mistake therefore appears in the High School Certificate Examination Regular, copy of which is annexure-3.

Opposite party no.5 is directed to consider the representation dated 25th October, 2016. He must do so in light of petitioner’s transfer certificate dated 22nd October, 2016 stating his name as Sumit Kumar Dhrua. Said opposite party is directed to cause the correction in the school leaving/transfer certificate. Petitioner will communicate this order along with copies of the transfer certificate dated 22nd October, 2016, school leaving/transfer certificate dated 13th August, 2007 and the high school certificate. Directed opposite party no.5 is to cause the correction, within three weeks of communication. Upon correction made by opposite party no.5, upon onward communication thereof, in terms of regulation 40, opposite party no.2, will also make the correction in the high school certificate.

The writ petition is disposed of.
