Judgment
dsThis is the first application filed by the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail relating to FIR/Crime No.463/2026 registered at Police Station-Civil Line, District-Chhatarpur (M.P.) for the offence punishable under Sections U/S 137(2) and 87 of BNS 2023 & under section 18 of POCSO Act. The applicant is in custody since 04.07.2026.
Learned counsel for the applicant submitted that applicant is innocent and has falsely been implicated in the case. He further submitted that applicant is 18 years of young boy and victim is aged about 15 years. He further submitted that the victim has stated in her statement recorded under Section 183 of the BNSS and has not supported the case of the prosecution version. He further submitted that the applicant has not committed any offence. It is further submitted that there is no likelihood for conclusion of trial in near future. Applicant is in jail since 04.07.2026 and he has no criminal record. In these circumstances, the applicants be released on bail.
Learned Panel Lawyer appearing for the State has opposed the bail application and submitted that at the time of incident prosecutrix was minor of 15 years. He further submitted that the applicant had taken the victim.. In these circumstances, application be dismissed.
Heard the counsel for the parties and perused the case diary.
Considering the aforesaid facts and circumstances of the case and looking to the age of the applicant and the victim, and the fact that nothing has been stated against the applicant in the statement of the victim recorded under Section 183 of the BNSS, this Court deems it appropriate to enlarge the applicant on bail. Accordingly, the bail application is allowed.
It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with two solvent sureties in the like amount to the satisfaction of the trial Court concerned for his appearance before the said Court on all such dates as may be fixed by that Court in this regard during the pendency of trial.
It is further directed that the applicant shall comply with the provisions of Section 480(3) of BNSS.
This order shall be effective till the end of the trial. However, in case of bail jump and breach of any of the conditions of bail, it shall become ineffective.
Accordingly, Misc. Criminal Case stands disposed of.
