Judgment
K. Haripal, J
The petitioner is the sole accused in Crime No.263/2021 of Neeleswaram Police Station, which was registered on 30.05.2021.
The allegation is that the petitioner was found illegally transporting 84 packets, each packet containing 180ml, of Indian made foreign liquor whisky
in an autorickshaw bearing No.KL-60-E-1653. On seeing the Police party, he took to his heels. He was apprehended on 04.06.2021 and since then is
in judicial custody.
Heard the learned counsel for the petitioner and also the learned Public Prosecutor.
Eventhough the learned Public Prosecutor pointed out that he is having antecedents, one case pointed out in which he is involved is under Section
379 IPC, Sections 20 and 21 of KPRBRRS Act and no antecedent with regard to commission of an Abkari offence is alleged against him. He is in
custody from 04.06.2021 onwards and having regard to the fact that the quantity involved is only 15.120 litres, he can be released on bail on the
following conditions:
i) The petitioner shall execute a bond for Rs.50,000/-(Rupees Fifty Thousand only) with two solvent sureties each for the like sum to the satisfaction of the trial court;
ii) He shall not try to contact or influence the witnesses or tamper with the evidence;
iii) Petitioner shall not leave India without permission of the jurisdictional court;
iv) He shall appear before the Investigating Officer/committal/trial court as and when required;
v) The petitioner shall strictly follow the various guidelines issued by the State and Central Governments with respect to keeping of social distancing in the wake of
Covid 19 pandemic;
vi) If any of the above conditions are violated by the petitioner, the jurisdictional court will be at liberty to cancel the bail in accordance with law.
This bail application is allowed as above.
