Ajay Tewari, J.—Learned counsel states that the claim of the petitioner in this petition is for release of medical reimbursement on account of treatment of deceased father of the petitioner, who was a Government servant. Learned counsel states that the Director, Health and Family Welfare has sanctioned the amount on 16.11.2010 and despite the fact that the petitioner issued legal notice dated 14.9.2011 (Annexure-P.2) to the respondent No.2, the payment has not been made.

Ms. Kavita Arora, learned Assistant Advocate General, Punjab, at the asking of the Court, accepts notice on behalf of the respondents.

Learned counsel for the petitioners undertakes to supply three copies of the petition to the learned Assistant Advocate General during the course of the day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution.

In view of the nature of the order which I propose to pass, there is no need to seek any counter reply from the respondents at this stage.

In the circumstances, respondent No.2 is directed to decide the legal notice (Annexure-P.2) of the petitioner within a period of one month by passing a speaking order and to remit whatever amount was found due within a period of one month. In case, the due amount to the petitioner is not remitted within the said period of one month, the petitioner shall be entitled to interest at the rate of 8 per cent from the date the amount fell due.

A copy of this order be given dasti to learned Assistant Advocate General, Punjab under the signatures of the Court Secretary.
