Heard learned Counsel for the parties.
Mr. Palekar, learned Counsel for respondent no.3, based on instructions, makes a statement that the impugned suspension order dated 06.10.2022 stands revoked with immediate effect. The petitioner will be forthwith reinstated. However, the respondent no.3 will take necessary steps as are permissible under the law inter alia to place the petitioner under suspension and/or to proceed with the disciplinary proceedings.
Accordingly, the statement made above is recorded and accepted. Consistent with such statement, the respondent no.3 shall forthwith reinstate the petitioner as Headmistress. However, this shall not preclude respondent no.3 from taking such steps as are permissible under the law, inter alia, for the petitioner's suspension, disciplinary proceedings, etc.
At this stage, we make it clear the we have not gone into the rival contentions and, therefore, all contentions of all parties on merits of the matter are left open.
The petition is disposed of. There shall be no order for costs.
All concerned to act on an authenticated copy of this order.
