The prayer in the present petition is for issuance of writ in the nature of mandamus directing the respondents to allot the petitioners booths/khokhas as assured by the Notified Area Committee Manimajra, which has been taken over by the Chandigarh Administration (respondent No. 1).
Learned counsel for the petitioners submits that petitioners were doing their business at the Khokhas since the year 1989 and subsequently they were asked to vacate those Khokhas and assurance was given to allot booths. He further submits that similarly situated persons have been allotted booths. He submits that claim of the petitioners has not been considered inspite of giving detailed demand notice dated 07.08.2018 (Annexure P-7) and still the same is pending with the respondent authority. He further submits that the petitioners would be satisfied in case directions are issued to respondent No. 1 to take action on the pending demand notice dated 07.08.2018 (Annexure P-7) and to consider them for allotment of booths like other similarly situated persons.
Keeping in view the limited prayer, the present petition is disposed of with a direction to respondent No. 1 to take action on demand notice dated 07.08.2018 (Annexure P-7) within a period of two months from the date of receipt of certified copy of this order.
