Judgment

Issue notice to the Respondent No.2, returnable on 19 July 2021. In addition to Court Notice, the Appellant is permitted to serve the Respondent
No.2 by way of private notice and to file affidavit of service in the Registry of this Court, after the Respondent No.2 is duly served.
Mr. Saraogi, learned counsel for the Appellant submitted that, the co-accused namely Mr. Kuldeep Singh Jaswant Singh Hira has been granted
interim relief by this Court by its Order dated 26 th April 2021. He submitted that, both the appeals are arising out of the same crime and may be
heard together to avoid repetition of arguments. In the present Appeal, the Respondent No.2 is yet to be served.
To be heard alongwith Criminal Appeal No.347 of 2021.
Till next date, the Appellant is granted interim relief.
a) In the event of arrest in CR No.190 of 2021 registered with Kalyan Railway Police Station, under Section 306 read with 34 of the Indian Penal
Code and under Section 3(2)(5) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989, the Appellant be released on bail on
his furnishing PR bond of Rs.20,000/- with one or two local sureties in the like amount.
b) Appellant shall not contact with the Respondent No.2 herein.
c) Appellant shall not tamper with the evidence and/or pressurize the prosecution witnesses.
d) Stand over to 19th July 2021.
