Petitioner herein is arrayed as the sole accused in Crime

No.84 of 2017 of Kottarakkara Excise Range for offence punishable

under section 55(i) of the Kerala Abkari Act.

According to the prosecution, on 21.05.2017 at

12.10p.m., petitioner was found in possession of 800ml of IMFL. He

was arrested on an allegation that it was meant for sale. Petitioner

herein is in custody since 21.05.2017 and seeks bail.

It is submitted by the learned Public Prosecutor that

petitioner is not involved in any other case. Substantial part of

investigation is over with the search and seizure. Having

considered these facts, I am inclined to grant bail to the petitioner

herein subject to the following conditions.

(i) Petitioner shall execute a bond for a

sum of Rs.40,000/- (Rupees forty thousand only)

with two sureties for the like sum each to the

satisfaction of the jurisdictional Court.

(ii) He shall not threaten, coerce or

intimidate the de facto complainant and the

witnesses nor shall he interfere in the process of

investigation.

(iii) He shall not get involved in any other

identical offences.

The bail application is allowed as above.
