Heard Ms. Manasi Dash, learned Amicus Curiae for the appellant and Mr. Priyabrata Tripathy, learned Addl. Standing Counsel for the State in part.

During the course of argument, when the statement of the victim recorded under section 164 Cr.P.C. as well as her evidence in Court was placed, it appears that on account of repeated sexual intercourse by the appellant, who is none else than the elder brother of the victim, with the victim, she became pregnant and delivered a female child at Swadhar Home, Malkangiri. It further appears that the appellant is a married person.

Learned counsel for the State shall obtain instruction about the status of the victim so also her child and also about the marital life of the appellant.

It further appears from the impugned judgment that the learned trial Court has held that the victim (P.W.6) is entitled for compensation under the Odisha Victim Compensation Scheme for which a copy of the judgment was sent to the Secretary, District Legal Services Authority, Malkangiri to do the needful.

Learned counsel for the State shall obtain instruction as to whether the victim has been paid any compensation or not and if so, what is the amount of such compensation.

The matter be listed in the week commencing from 28th August 2023.

Let a free copy of the order be handed over to the learned counsel for the State for compliance.
