Judgment
Heard Mr. D. Biswas, learned counsel appearing for the accused-petitioners as well as Mr. Ratan Datta, learned PP appearing for the State-respondent.
This is an application filed under section 438 Cr.P.C. for granting pre-arrest bail to the accused-petitioners in connection with Birganj PS case No. 34 of 2020 under Sections 498A/306/34 of the IPC.
An FIR was lodged against the accused-petitioners by the complainant stating inter alia that they were involved in torturing and abetting the deceased for committing suicide.
I have perused the case diary as produced by Mr. Ratan Datta, learned PP.
Having perused the materials on record, I am of the opinion that, this is a fit case to grant pre-arrest bail to the accused-petitioners.
Accordingly, it is ordered that in the event of arrest, the accused-petitioners, namely, Smt. Mayarani Das and Sri Sukumar Das, shall be released on pre-arrest bail, on furnishing bail bond of Rs. 50,000/- each supported with one surety each of the like amount to the satisfaction of the Arresting Authority.
However, it is specifically directed that the accused petitioners shall appear before the Investigating Officer within a period of 7 (seven) days from today and the Investigating Officer is given liberty to interrogate the accused petitioners in connection with the present case. The accused-petitioners are also directed to co-operate and assist the investigating officer to unearth the truth behind the incident.
With the above direction, the instant application stands allowed and, thus disposed of.
