This is a petition under Section 482 Cr.P.C. for issuance of direction to respondent Nos. 2 and 3 to conduct an inquiry on a complaint given by the
petitioner (Annexure P-1) to take an appropriate action private respondents.
A perusal of this petition shows that it is a totally vague petition in which no details have been given.
Para 2 to 4 of this petition reads as under :-
“2. ....That the background of the matter is that petitioner is the victim of the case as he has been attacked by respondent Nos.5 and 6, through
social media and they are spoiling his image be creating wrong impression in the minds of the general public and making open comments on facebook
against the character of my client.
That respondent Nos. 5 and 6 are intentionally making such post on social media and also it has come to the knowledge that they are not the
registered journalist they are using their journalism to black mail people they have been demanding money from my client otherwise they will keep on
defaming him. Till the decision of the court the journalist cannot make any comment on the character of my client this is wrong practice of
journalism.â€
That the petitioner made representation dated 06.02.2021 and repeated request to the higher police authorities. Copy of the same is annexe here as
Annexure P-1.â€
In order to find out as to what is the grievance of the petitioner, when the Court tried to find out from the representation (Annexure P-1), it is found
that even the notice is equally vague and evasive.
The two paragraphs of the aforesaid legal notice read as under:-
“1. “That my client is the victim of the case as he has been attacked by the accused persons through social media and they are spoiling his
image by creating wrong impression in the minds of the general public and making open comments on facebook against the character of my client.
That accused persons are intentionally making such post on social media and also it has come to the knowledge that they are not the registered
journalist they are using their journalism to black mail people they have been demanding money from my client otherwise they will keep on defaming
him. Till the decision of the court the journalist cannot make any comment on the character of my client this is wrong practice of journalism.â€
A perusal of the petition further shows that neither the petitioner has resorted to remedy under Section 154 Cr.P.C. for approaching SHO or the
Superintendent of Police seeking any action nor any representation has been given and straight away a legal notice dated 06.02.2021 is given,
however, nothing is stated in this petition as to how and by what mode this notice was given as no postal receipt or any acknowledgement receipt is
attached with the petition.
Learned State counsel, on instructions from ASI Baljinder Singh, submits that in the complaint given by Daljeet Kaur, an FIR bearing No. 15 dated
14.01.2021 was registered against the petitioner under Sections 452, 354-A, 323, 506 and 34 of the IPC at Police Station Jandiala, Amritsar (Rural).
Learned State counsel further submits that registration of the FIR was published by respondent Nos. 5 and 6, who are the journalists of Sanj Khabar
and Chardi Kala Time TV and therefore, the petitioner has filed the present petition.
After hearing learned State counsel and going through the entire petition as well as the notice and also in view of the fact that before filing this petition
no complaint under Section 154 Cr.P.C. was given, I find no ground to entertain the present petition and the same is dismissed with a cost of
Rs.10,000/-to be deposited with District Legal Services Authority, Amritsar.
