Judgment
SUDHANSHU DHULIA, J. (ORAL)
Pursuant to an FIR lodged by respondent no. 2 lodged against the accused applicant for the offences under Sections 323, 504, 506 IPC in Police
Station Bajpur, District Udham Singh Nagar, investigation has been done and the chargesheet has been filed and the applicant has been summoned to
face the trial for the offences under Sections 323, 504, 506 and 325 IPC. Aggrieved, the accused applicant has challenged the summoning order dated
01.10.2016.
On perusing the impugned summoning order, FIR and other relevant papers, this Court is of the opinion that no interference is liable to be made in
the present matter. This criminal miscellaneous application under Section 482 CrPC is hereby dismissed. However, considering that the accused
applicant is a student and he had cooperated during the course of investigation, the bailable-warrant issued against him is put in abeyance for a period
of one week only, i.e. till 16.8.2018 only, in order to enable him to appear before the Court below which shall consider these facts while considering his
bail application and shall decide the bail application on the same day.
It is made clear that any observation made by this Court shall not prejudice the trial against the accused applicant.
Registry shall supply a copy of this order to learned Counsel for the applicant today itself on payment of prescribed charges.
