Judgment
Arindam Lodh, J
Heard Mr. Suman Bhattacharjee, learned counsel appearing for the applicants.
This is an application filed under Section 151 of the Code of Civil Procedure, 1908 for withdrawing share of applicant no.5 deposited by the State of Tripura and Others, i.e. the appellant-respondents herein.
It is stated in the withdrawal petition that the applicants no.1 to 4 earlier filed applications to withdraw their respective shares from the deposited amount before this Court deposited by the appellant-respondents.
The applicant no.5, as she was minor at the relevant period of time, could not withdraw the amount. Besides, the Court had passed an order that her share would not be permitted to be withdrawn till she attains the age of 21 years. Now, it is stated that the applicant no.5 has attained the age of majority and as such, there is no impediment to release her share of money out of the total deposited amount.
Considering the statements, I am inclined to allow this application for withdrawal of the share of applicant no.5 which is kept in the safe custody of the High Court. The Registry is directed to allow the applicant no.5 to withdraw her share out of the total deposited amount.
The instant application accordingly stands allowed and thus disposed.
