Judgment
Ritu Bahri, J.—The learned Counsel appearing on behalf of Respondent No. 1 has placed on record the order dated 19.10.1988, vide which the Petitioner was reinstated back in service with continuity of service.
As per the award dated 20.7.1988, the reference was answered in favour of the workman and he was directed to be reinstated with continuity of service but without back wages. It has been observed by the learned Labour Court that his services were terminated on 5th September, 1975. He raised a demand notice on 15th July, 1980 and statement of claim was filed on 11th September, 1987. The Labour Court has observed that the workman has not taken any steps to get the dispute referred expeditiously to the Government for adjudication. He slept over his claim for almost 12 years. In this background of the fact benefit of back wages has been denied to the workman.
I see no infirmity in the order of the learned Labour Court. The writ petition is dismissed on this ground.
