Prayer in the present writ petition filed under Articles 226/227 of Constitution of India is for issuance of a writ in the nature of Certiorari for quashing the order dated 08.01.2020 (Annexure P-17) vide which the promotion order of the petitioner dated 07.11.2019 (Annexure P-15) has been withdrawn arbitrarily; and further for quashing the impugned order 29.09.2020 (Annexure P--19) whereby, the claim of the petitioner was again rejected by respondent No.1, without considering the facts and submissions made by the petitioner to the respondent authority. It is submitted that in view of the judgment of the Hon’ble Supreme Court dated 03.11.2017 (Annexure P-11), petitioner appeared in the test/ examination conducted by AICTE and cleared the same. Therefore, the degree obtained by the petitioner has been fully revived as per judgment of the Hon’ble Supreme Court dated 03.11.2017 (Annexure P-11) and degree has been validated from the date when it was obtained; AND/OR further, prayer has been made for issuance of a writ in the nature of in the nature of Mandamus directing the respondents to allow the petitioner to work on the post of SDE in pursuance of the promotion order dated 07.11.2019 (Annexure P-15) as the petitioner is duly eligible for the same as per service rules.

At the very outset, learned counsel for the petitioner submits that during the pendency of instant writ petition, the petitioner has submitted a representation dated 11.05.2026 to the respondents for consideration of his case in terms of judgment dated 09.04.2026 passed by a Division Bench of this Court in CWP-1591-2017 titled as Rajpal and another vs. State of Haryana and others, upon which vide letter dated 20.07.2026, it has been informed by the respondents that case of the petitioner is under active consideration. It is accordingly prayed by learned counsel for the petitioner that the petitioner would be satisfied at this stage ifif the present writ petition is disposed of with a direction to respondents to decide the aforesaid representation dated 11.05.2026 in a time bound manner, in terms of judgment of the Division Bench of this Court in Rajpal’s case (supra).

A copy of representation dated 11.05.2026 moved by the petitioner along with copies of letter dated 20.07.2026 and judgment dated 09.04.2026 in Rajpal’s case (supra) handed over in Court by learned counsel for the petitioner is taken on record.

Learned counsel for the respondent-State submits that he has ‘no objection’ in case the prayer made by learned counsel for the petitioners at this stage, is accepted.

After hearing learned counsel for the parties, without going into the merits of the present petition, the same is disposed of with a direction to the respondents/Competent Authority, concerned to forthwith consider and decide the aforesaid representation dated 11.05.2026 by passing a speaking and reasoned order, in accordance with law within a period of 02 months from the date of receipt of certified copy of this order, while keeping in mind the judgment passed by the Division Bench of this Court in Rajpal’s case (supra).
