Judgment
U.C. Maheshwari, J.—Heard on the question of admission.
Admit.
Learned PL takes notices of this admission and undertakes to produce the case diary at the time of final hearing.
Also heard on I.A. No. 551/10, an application for grant of ad interim regular bail as he is in custody in connection of Crime No. 110/09, registered at Police Station, Bichhiya, District Mandla, for the offence under Sections 420, 468, 471, 477(B), 120-B of IPC and Section 3/7 of Essential Commodities Act.
As per submission of the applicant''s Counsel, the applicant was posted as Choukidar in the alleged Fair Price Shop of Co-operative Society and he was not empowered to carry out or look after regular business affairs of the society. The same was looked after by Manager namely Amar Singh, co-accused of the instant case, who has been extended the benefit of ad interim anticipatory bail, vide order dated 5-11-09 in M.Cr.C. No. 11048/09, and where there is no such allegation against the applicant. In spite that he is facing the judicial custody since 23-12-09 and prayed for bail till the time the case diary is received and the petition is decided finally.
Having heard, perused the impugned rejection order along with the papers available on record and the said order granting ad interim anticipatory bail to the co-accused, in the available circumstance, without expressing any opinion on merits of the matter, subject to final decision, this LA. is allowed and the applicant is extended the benefit of interim regular bail.
It is further directed that on furnishing a personal bond of Rs. 20,000/-(Rs. Twenty thousand) along with one surety of the like amount to the satisfaction of the Trial Court by the applicant, he shall be released on bail.
Let this matter be listed for final hearing in the week commencing 15-2-2010.
