Notice. Mr. Ajay Kumar Chauhan, learned counsel appears and waives service of notice on behalf of the respondents.

The present petition has been filed for grant of the following substantive reliefs:-

“i) That respondents may kindly be directed to release the payment/dues for 89 days (compensatory/weekly rest) with up to date interest in the light of judgment passed by this Hon'ble High Court of H.P. in CWP/5179/2022 titled as Dhani Ram vs. HRTC & another dated 16.03.2023.

ii) That respondent may kindly be directed to consider the representation of petitioner and to release the arrear of compensatory leaves/weekly rest with up to date interest.”

It is submitted by learned counsel for the petitioners that the issue in question is squarely covered by the judgment of this Court passed in CWP No. 5179 of 2022 along with connected matters, titled as Dhani Ram vs. HRTC & another, decided on 16th March, 2023. This is a matter, which is required to be considered by the respondents.

In the given facts and circumstances and without going into the merits of the case, we deem it fit and appropriate to dispose of the instant petition with a direction to the respondents to consider and decide the case of the petitioner in light of aforesaid judgment (Annexure P-2) and in case, the same is found to be covered, same and similar benefits as were granted to the petitioners in Dhani Ram's case (supra), be also granted to the petitioner herein. Ordered accordingly. The entire exercise be completed within eight weeks.

Pending application(s), if any, shall also stand disposed of.
