Judgment
The mother of Convict No.369/2026 (Nikhil @ Nigin), of the Central Prison and Correctional Home, Kannur, has filed this writ petition under Article 226 of the Constitution of India, for a direction to the third respondent to grant emergency leave to the above prisoner to attend post-funeral rites of her brother (uncle of the convict).
Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State of Kerala.
The learned Public Prosecutor has opposed the request for the grant of emergency leave. It is submitted that, if necessary, escort parole could be ordered to enable the above prisoner to participate in the post-funeral functions of his uncle.
Having regard to the reasons stated by the petitioner for the grant of emergency leave to her son, I deem it appropriate to direct the third respondent to grant emergency leave to the above prisoner for a period of three days from 29.09.2026.
In the result, the writ petition stands allowed as follows:
The third respondent is hereby directed to issue necessary orders granting emergency leave for a period of three days to Convict No.369/2026 (Nikhil @ Nigin), of the Central Prison and Correctional Home, Kannur, for a period of three days from 29.09.2026 to enable him to participate in the post-funeral rites of his uncle.
