We do not see any reason to interfere with the decision of the learned Magistrate. The accused was convicted of rioting u/s 147 of the Indian Penal Code. On the evidence, it is dear that there was an unlawful assembly and, on the evidence, the Magistrate was satisfied that the accused was the leader of the gang whose common object was to assault the passers-by. rule discharged.
