Heard the Learned Counsel for the Applicant and perused the record.

This is an Application under Section 17(6) of the SARFAESI Act, 2002 wherein a direction is sought for expeditious hearing of the S.A. No. 266 of 2024 which is pending before the Learned DRT-III Kolkata. Learned Counsel for the Applicant would submit that the matter was listed for hearing on 23.09.2024. Since then, the matter is pending for hearing. A direction may be issued for expeditious hearing of the matter.

It is observed that no Presiding Officer is posted in DRT-III Kolkata since January, 2026. Presiding Officer of DRT -II Kolkata is holding additional charge of DRT-III Kolkata. Both the DRTs have heavy pendency.

The Order sheet annexed with the Application dated 10.06.2025 and 09.06.2026 would reveal that the Learned Presiding Officer DRT-II Kolkata holding additional charge of DRT-III Kolkata has passed effective order on 09.06.2026. Learned DRT heard the Learned Counsel for the parties on an Application for interim relief which was dismissed by him. Accordingly, now the matter is listed on 11.09.2026. Accordingly, it cannot be observed that any progress is not being made in the pending S.A. Presiding Officer DRT-II Kolkata is taking up the matter.

In such circumstances, no further direction for expeditious hearing could be given. Application is devoid of any merit and is liable to be dismissed.

Pending I.A.s if any, are disposed of accordingly.

Interim order, if any, stands vacated.

File be consigned to Record Room.
