Judgment
R. Basant, J.—This judgment must be read in continuation of the earlier orders passed by us resting with the order dated 13.08.2010.
Today when the case is called, the petitioner along with his parents, brother and sister-in-law are present. He is represented by a counsel. The 1st respondent is present along with his wife and his elder brother. Along with them, the alleged detenue has also come to Court. The learned Counsel for the petitioner, the learned Counsel for the 1st respondent and the learned Government Pleader are also present.
We continued our interactions with the parties. We find that the parties have settled all their outstanding disputes.
This Writ Petition is accordingly allowed. We record below the terms of their agreement and issue the following directions accordingly.
i) All concerned agree that the marriage between the petitioner and the alleged detenue shall be solemnised at Guruvayur Temple on 22.08.2010 between 7 a.m. and 9 a.m.;
ii) Immediately thereafter the marriage shall be registered with the local authority at Guruvayur;
iii) The alleged detenue along with her parents and other relatives shall reach Guruvayur tomorrow evening, i.e. 21.08.2010;
iv) After the marriage, the spouses along with the relatives of the petitioner shall proceed to the house of the petitioner''s father. They shall reside there on that day and shall go to the house of the 1st respondent on the afternoon of 23.08.2010. They shall reside there on 23.08.2010;
v) On the afternoon of 24.08.2010, the petitioner and the alleged detenue - spouses, shall return from the house of the 1st respondent to the apartment of the petitioner at Ernakulam. They shall continue to reside there thereafter;
vi) The petitioner and the alleged detenue shall thereafter take appropriate decision about the continuance of education of the alleged detenue. She is a student of the M.B.A Course now. She shall continue her education either at Coimbatore or at Ernakulam. The parents of the alleged detenue as also the alleged deenue insist that the alleged detenue must continue her education whether it be at Coimbatore or at Ernakulam, this year itself. The petitioner undertakes that the alleged detenue shall continue her education - in the M.B.A course. All others leave it to the petitioner and the alleged detenue to take an appropriate decision as to where the alleged detenue must continue her education.
We post the case to 27.09.2010 for appearance of the petitioner and the alleged detenue and for report from them that all stipulations made above have been complied with.
