27.05.2026: These appeals are against an impugned order dated 24.04.2026 wherein the Ld. NCLT has passed following order:
“2.The present Interlocutory Application has been filed by Mr. Sudhir Thackersey, the original petitioner, under Section 242 of the Companies Act, 2013, seeking stay of the Board Meeting scheduled on 28th April 2026 proposed to be held by Respondent No. 1 Company along with seeking access to documents of Respondent No. 1, Parnakuti LLP, and other necessary records.
3.Learned counsel for the Respondents appears and accepts the notice in the application. The Respondents shall be at liberty to file their reply in this application before the next date of hearing after serving a copy thereto to the other side. The Main Company Petition is listed on 29th April 2026.
4.List this matter on Board on 29.04.2026 for further consideration.”
It is the submission of Ld. Sr. Counsel for the Appellant they had pressed for stay before the Ld. NCLT on 24.04.2026 but it was not granted and the next date given was on 29.04.2026 but whereas board meeting was scheduled on 26.04.2026 wherein authorisation of the Appellant to represent the Respondent No. 1 company in the Parnakuti LLP was changed.
In any case, the board meeting has now been held and resolution been passed, hence the appeals have become infructuous. Thus, we dispose of these appeals with a liberty to the appellants to file application(s) for status quo ante, -3-and the Ld. NCLT after following due process to dispose of these applications as expeditiously as possible. These appeals are disposed of. Pending application(s), if any, in all these appeals are closed. The rights and contentions of both the parties shall remain intact.
