Sudhir Kumar vs State of Haryana and Others

M.M. Kumar, J.—This petition filed under Article 226 of the Constitution prays for issuance of a writ in the nature of mandamus directing the official respondents to reckon the period of service of the petitioner w.e.f. 1.6.1989 to 13.7.1989 and then from 7.12.1993 till his termination after the strike by the employees of the Transport Department of Haryana was over, for all intends and purposes including the purpose of regularisation and fixation of pay etc. A further prayer has also been made to refix the pay of the petitioner and release of arrears and to regularize his previous service as has been done in the case of respondent Nos. 7 to 9.

For the relief claimed in the instant petition, the petitioner has already sent a legal notice, dated 3.9.2005 (P-4) to the respondents.

Without going into the merits of the case, we deem it just and appropriate to direct respondent No. 2 to take cognizance of the legal notice, dated 3.9.2005 (P-4) sent by the petitioner and decide the same expeditiously preferably within a period of four months from the date a certified copy of this order is presented to them. It shall be appreciated if a speaking order is passed.

Petition stands disposed of in the above terms.
