Judgment
M.S.Sahoo, J
The BLAPL has been filed under Section 439, Cr.P.C. seeking release on bail by the petitioner, who is in jail custody in connection with Turumunga P.S. Case No.94 of 2023 corresponding to G.R. Case No.445 of 2023 pending in the court of the learned J.M.F.C.(CT), Keonjhar, for alleged commission of offences under Sections 498-A/323 of the I.P.C. read with Section 4 of the D.P. Act.
Learned counsel for the petitioner further submits that the petitioner being a local resident there is no apprehension he fleeing the jurisdiction of the court and he shall abide by all the conditions that would be imposed to grant him bail.
Learned Standing Counsel for the State vehemently opposes the prayer of the petitioner to grant bail.
Having heard learned counsel for the parties and considering the material available on record, this Court is inclined to grant bail to the petitioner subject to the stringent conditions that would be imposed by the learned court in seisin of the matter along with condition that if any such further complaint is received from the wife or any family members regarding torture/assault by the petitioner, they shall move for cancelation of bail and also the law enforcement agency shall move for cancelation of bail
The BLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
