Judgment
Heard Mr. S. Saha, learned counsel appearing for the accused-petitioner as well as Mr. Ratan Datta, learned PP appearing for the State-respondent.
This is an application filed under section 438 Cr.P.C. for granting pre-arrest bail to the accused-petitioner, who is wanted in connection with Jirania PS case No. 26 of 2020 under sections 302/201 of the IPC.
The allegation is that the accused-petitioner conspired with one Smt. Bina Rani Debbarma to commit murder of Surbir Debbarm @ Uttam, the husband of said Bina Rani Debbarma. It is the further allegation that Smt. Bina Rani Debbarma, the wife of the deceased had killed her husband by electrocution and the present petitioner had conspired such murder with Smt. Bina Rani Debbarma.
Mr. Saha, learned counsel appearing for the accused-petitioner submits that the accused-petitioner is not at all involved with the alleged crime, which might have been committed by the wife of the deceased.
I have perused the case diary, as submitted by the learned PP.
On perusal of the case diary, I find there were conversations between the accused-petitioner and Smt. Bina Rani Debbarma.
Considering this aspect, at this stage the instant application for granting anticipatory bail to the petitioner stands rejected.
The petitioner is at liberty to appear before the Investigating Officer and clarify and divulge the actual state of affairs to the investigating officer. The Investigating Officer, after affording all sorts of opportunities to the accused-petitioner shall take appropriate course of action in accordance with law.
