Judgment
The affected wife come up with this petition based on her representation dated 07.08.2026, wherein it is stated thus:
''The petitioner’s husband Mr.Kannan threatened the petitioner to give the immovable property and also the gold jewels; the petitioner and the said Kannan married in the 1997 and out of the wedlock, one female child born; and that child became grown and already married''.
The petitioner also sent the said complaint to the State Women Commission, the State Human Rights Commission, the Director General of Police, the Superintendent of Police, Dindigul, the Inspector of Police, Dindigul North, the Inspector of Police, All Women Police Station, Dindigul and the Inspector of Police, Aundipatti Police Station narrating the circumstances she underwent. The petitioner also stated in the complaint that her husband and his associates made different phone calls in different dates from different numbers harassing the petitioner to give her jewels and property in the name of her husband and otherwise, they will do away the life of the petitioner. Since no action is taken on her complaint, the affected woman is before this Court for a direction.
The learned Government Advocate (Crl.side) submitted that the second respondent received the said petition on 10.08.2026 and issued summons on 11.08.2026 and the same was returned with the endorsement that the petitioner is not available in the address. The learned Government Advocate (Crl.side) also submits that since the petition is pending enquiry, suitable direction may be given to the police.
Recording the above submissions of both sides, a question was put to the learned counsel for the petitioner to confirm the fact whether the petitioner is residing in the Nagal Puthur, Nagal Nagar, Adiyanuthu, Dindigul or not. The learned counsel for the petitioner submitted that the said address is the original address and presently, the petitioner is residing at Aundipatti in one relative's house.
Therefore, the learned counsel for the petitioner is directed to inform the petitioner to appear before the respondent police.
The learned counsel for the petitioner submitted that he will inform the petitioner to appear before the respondent police.
The respondent police are directed to give intimation again to the parties concerned to appear before them. On appearance of the parties, the respondent police are directed to enquire the petitioner as well as the petitioner's husband and after recording the statement from both sides, take a better decision within a period of six weeks from the date of appearance of the parties before the respondent police.
With the above direction, this petition is disposed of.
