Instant petition came to be filed by the petitioner seeking permission to appear in BA Part-II Examination and under interim protection granted by the Court vide order dt. 20.3.2012 he was permitted to appear and the result was kept in sealed cover. However, Matter has come up on application No. 40925 dt. 6.9.2012 filed by the petitioner for declaration of result of BA Part-II Examination in which he appeared under interim order of the court dt. 20.3.2012.
The dispute which arose for consideration in the instant petition is that after pursuing studies of BA Part-II after depositing admission fee for the academic year 2011-12 and who was eligible to appear in the ordinary course but was not permitted to appear in BA Part-II Examination. However, in reply which came to be filed by the respondent it has come on record that examination fee was not deposited as regards the present petitioner and for that the college alone can be held responsible and the dispute only remains in very short compass as regard fee to be deposited by the petitioner.
It may not of relevant to examine as to who shall be responsible whether the college or the student but the question remains that on depositing the requisite examination fee the petitioner who appeared under interim order of the Court is at least entitled to seek declaration of result of BA Part-II. Consequently, the writ petition stands disposed of with direction to the respondents to declare result of the petitioner of BA Part-II in which he appeared under interim order of the Court dt. 20.3.2012 on depositing of requisite fee which may be informed to the petitioner within one week.
