Judgment

On account of prevailing conditions worldwide brought about by the COVID-19 virus, the present application has been heard through video
conferencing in order to maintain social distancing. The necessary parties have effectively been represented by their respective counsel via video
conferencing.
Heard and perused the record.
This is first bail application under Section 438 of the Cr.P.C. filed by the applicant for grant of anticipatory bail in connection with Crime No.66/2021
registered at Police Station Dolariya, District Hoshangabad (M.P.) for offence punishable under Sections 353, 332, 294, 506 of IPC.
It is alleged against the applicant that he obstructed the complainant while discharging the duties as he was obstructing the flow of water.
Learned counsel for the applicants submits that against the applicant, allegations are that he obstructed the applicant and caused simple injury. It is
further submitted that the applicant shall co-operate with the investigation and will not tamper any evidence. During COVID-19, he may not be
directed to be arrested by the Police.
Considering the aforesaid submissions and totality of the facts of the case, I am of the view that the applicant be granted anticipatory bail. Therefore,
without expressing any opinion on the merits of the case, this application is allowed.
It is directed that in the event of Rs. 50,000/- (Rs.Fifty Thousand Only) with one surety in the like amount to the satisfaction of arresting officer. T he
applicant shall further abide by the other conditions enumerated in sub-section (2) of Section 438 of Cr.P.C.
A typed copy of this order be forwarded by the Registry to the Office of the Advocate General and to Shri Yashovardhan Shukla, learned Panel
Lawyer, on their respective email addresses, for intimation to the police station concerned.
