Alok Singh, J.—Mr. S.S. Sandhu, learned counsel appearing for the respondents, has fairly stated that copy of the order passed by Passport Office, Jalandhar, as mentioned in Annexure P-12 at page 63, shall be supplied to Mr. Amit Rawal, learned counsel for the petitioner, within a week from today.

Mr. Amit Rawal, learned counsel for the petitioner, states that order impugned is appealable u/s 11 of the Passport Act. He states that only difficulty now is that limitation to file an appeal has expired. He states that appeal shall be filed within 10 days from the date copy of the order, as undertook by learned counsel for the respondents, is supplied to him, however, same may not be dismissed on the ground of limitation. He seeks permission to withdraw this petition.

Dismissed as withdrawn with liberty to the petitioner to file an appeal u/s 11 of the Passport Act within 10 days from the date copy of order is supplied to him by learned counsel for the respondents. If appeal is filed within 10 days thereafter, it shall not be dismissed on the ground of limitation and shall be decided on its own merit in accordance with law without granting any unnecessary adjournment.
