Judgment
Heard learned counsel for the parties.
This bail application has been moved on behalf of the
petitioner in FIR No. 209/2017, P.S. Balghat, District Karauli
registered for the offence under Sections 341, 323, 354, 354-A &
354-D IPC.
Learned counsel for the petitioner submits that the
accused is in custody since 04.12.2017 and charge-sheet has been
filed against him in this matter.
Learned Public Prosecutor as well as learned counsel for
the complainant has opposed the prayer on the ground that two
other cases are also pending trial against him and he has been convicted in one case for the offence under Sections 323 & 341
IPC.
Without expressing any opinion on the merits of the
case but taking into consideration the overall facts and
circumstances of the case, I deem it just and proper to enlarge
the petitioner on bail.
Consequently, the bail application filed by him under
Section 439 Cr.P.C. is allowed.
It is ordered that the accused-petitioner Sudama S/o
Lohde in F.I.R. No.209/2017, registered at Police Station Balghat,
District Karauli, shall be released on bail; provided he furnishes a
personal bond of Rs.25,000/- with two surety bonds in the like
amount to the satisfaction of the learned trial court with the
stipulation to appear before that Court on all dates of hearing and
as and when called upon to do so.
