Since these four bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Bhawanipatna Cyber Crime and Economic Offences PS Case No.20 of 2025 corresponding to CT Case No.1233 of 2025 pending in the file of learned SDJM, Bhawanipatna, for commission of offences punishable U/Ss.336/318/340/61(2)/3(5) of the BNS r/w Sections 66-C & 66-D of the IT Act.
The allegation against the Petitioners is that some of them have consciously allowed their bank accounts to be used by the cyber fraudsters to commit online financial fraud and some of them have supplied the bank credentials of different persons to the cyber fraudsters by collecting the same in lieu of payment of some rupees and, thereby, facilitating commission of financial fraud. Accordingly, some ill-gotten money have been credited to the account of some of the Petitioners, which were subsequently diverted.
Heard, Mr. Jayadeba Behera, learned counsel for the petitioners in BLAPL No. 3425 of 2026; Mr. Sukanta Kumar Dalai, learned counsel for the Petitioner in BLAPL No. 3536 of 2026; Mr. Pramod Kumar Bohidar, learned counsel for the Petitioner appearing virtually in BLAPL No. 5707 of 2026; Mr. Ankann Panda, learned counsel for the Petitioner appearing virtually in BLAPL No. 5739 of 2026 and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record.
After having considered the rival submissions upon perusal of record, no doubt there appears allegation against the Petitioners for facilitating use of bank accounts by the cyber fraudsters for committing online financial fraud, but none of them appears to have been directly involved in online financial fraud. The Petitioners are in custody for some time and in the meantime, charge sheet has already been submitted. Besides, co-accused Chintamani Meher has already been granted bail by this Court in BLAPL No. 4510 of 2026. In the aforesaid premises and on consideration of the materials placed on record, this Court without expressing any view on merits admits each of the petitioners to bail.
Hence, these four bail applications of the petitioners namely Sudam Meher and Gopabandhu Meher (In BLAPL No.3425 of 2026), Naresh Kumar (In BLAPL No.3536 of 2026), Durga Kanta Mahala @ Durgakanta Mahala (In BLAPL No. 5707 of 2026) and Dayanidhi Sarap (In BLAPL No. 5739 of 2026) stand allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with one solvent surety each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
