I have heard Mrs. S. Deb (Gupta), learned counsel appearing for the petitioner and Mr. D. Sarma, learned Addl. GA appearing for the State- respondents.
The case of the petitioner is that in response to an advertisement dated 12.02.2021, he applied to the post of Fitter [Junior Multi Tasking Operator (un-common)]. At the time of submission of the application under advertisement dated 12.02.2021, the petitioner became over-aged. However, there is a clause in the advertisement dated 12.02.2021 that if a candidate applied for any post in response to the advertisement published in the year 2017 which was cancelled later on, then one-time relaxation of age would be given to such candidate.
The simple case of the petitioner is that he is entitled to get one time relaxation of age since he applied to the post of Junior Fitter in response to the advertisement published in the year 2017. It is further case of the petitioner that he applied again to the post of Fitter in view of Advertisement dated 12.12.2021, but his selection was cancelled since, according to the respondents he suppressed the matter that he was over-aged. To establish that the petitioner appeared in the earlier selection process that was initiated in response to the advertisement in the year 2017, he relied upon a certificate (Annexure-3 to the writ petition) issued by the Director of Agriculture, Tripura. In my opinion, this certificate issued by the Director of Agriculture, Tripura is not enough to establish the case of the petitioner that he participated in the selection process that was initiated in the year 2017. The petitioner must produce the copy of his application which was submitted before the competent authority in response to the advertisement in the year 2017, the admit card to appear in the written test and the call letter to participate in the viva voce test. In the absence of those documents, in the opinion of this Court, the present writ petition may not be maintained.
Mrs. S. Deb(Gupta), learned counsel for the petitioner has submitted that she requires two days’ time to produce all those documents.
I have considered the submission of learned counsel for the petitioner and the matter may be listed on 08.01.2025 for production of those documents by way of affidavit.
