Subodh Kumar vs State Of Uttarakhand

Applicant Subodh Kumar is in judicial custody in Case Crime No.475 of 2022, under Sections 376 D, 376DB 363, 366, 366A IPC and Section 5(g)(m)/6 of the Protection of Children from Sexual Offences Act, 2012, Police Station Kotwali Roorkee, District Haridwar. He has sought short term bail on the ground of illness of his father.

Heard learned counsel for the parties and perused the record.

Learned Senior Counsel appearing for the applicant would submit that the father of the applicant has some problem; he is the only male member in the family; his father is 65 years of age; the mother of the applicant is 64 years of age; and one sister of the applicant is married; the father of the applicant has to be taken to higher centre. Therefore, short term bail is required.

Having considered, this Court is of the view that there are persons to look after the father of the applicant. It is not such a case in which short term bail may be granted to the applicant. Accordingly, the short term bail application deserves to be rejected.

The short term bail application is rejected.
