Judgment

The present petition under Section 482 of Cr.P.C. has been filed by the petitioner against the orders dated 02.12.2023 and 25.01.2024 passed by Judicial Magistrate First Class, Gwalior in Case No.SC-NIA-3393/2016, whereby the learned Trial Court had closed the right of the petitioner to lead further evidence without there being any fault on the part of petitioner.
O n the basis of the aforesaid, a limited prayer has been made by the counsel for the petitioner that the impugned orders dated 02.12.2023 and 25.01.2024 may kindly be set aside and petitioner may kindly be afforded an opportunity to lead further evidence.
After hearing counsel for the petitioner and going through the records, this Court deems it fit to set aside the orders dated 02.12.2023 and 25.01.2024 passed by Judicial Magistrate First Class, Gwalior in Case No.SC-NIA-3393/2016 and direct the learned Court below to grant opportunity of hearing and leading evidence to the petitioner, subject to payment of cost of Rs.10,000/- (Rupees TenThousand Only) to be deposited with the M.P. State Bar Association, Gwalior within a period of ten working days from today.
With the aforesaid direction, the petition stands allowed and disposed of.
