On 30.08.2018, the notices of application under Section 5 of the Limitation Act were directed to be issued. In pursuance to the said order, PF and notices were filed but extra sets of the application under Section 5 of the Limitation Act were not filed despite time been granted thrice by Deputy Registrar (Judicial) and Registrar (Admn.).
Ultimately, on 05.07.2023, the service on respondent Nos.1, 2, 4 & 5 was dispensed with. However, notices for respondent No.3 were directed to be filed within a period of two weeks. The same having not been filed, the matter was listed before the Court on 19.01.2024. On that date, last opportunity of one week was granted to do the needful. It was also observed on that date that if the requisites are not filed within the stipulated period, the appeal shall be listed before the Court for dismissal. In pursuance to the said order, the appeal has been listed today.
Today, none has appeared for the appellant.
As per the office report, the requisites have also not been filed.
In view of the same, the appeal is dismissed in non-compliance.
