This matter is taken up through hybrid arrangement (virtual/physical mode).
This application has been filed by the Informant seeking cancellation of bail granted to the Opposite Party No.2 in connection with Special Case No.346 of 2020 pending trial before the learned Additional Sessions Judge-cum-Special Judge, Balasore.
Heard learned counsel for the Petitioner (Informant) and learned counsel for the Opposite Party No.2 (accused).
Keeping in view the submissions made, the order dated 09.08.2021 passed by the learned Additional Sessions Judge-cum-Special Judge, Balasore being perused; it is seen that the Opposite Party No.2 being the accused for alleged commission of offence under sections 498-A/34, I.P.C. had been granted bail by this Court in BLAPL No.3613 of 2021 and thereafter was released from custody on 10.08.2021 and this application for cancellation of bail has been filed on 23.12.2021.
The averments made in the petition being gone through and taken into account in their proper prospective, this Court is of the view that no case for cancellation of the bail is made out.
The CRLMA is accordingly dismissed. Issue urgent certified copy as per rules.
