Applicant Subhaan @ Behra is seeking anticipatory bail in FIR No. 0081 of 2020, under Sections 3 & 11 of The Uttarakhand Protection of Cow Progeny Act, Police Station Bhagwanpur, District Haridwar.
Heard learned counsel for the parties and perused the material available in file.
Learned counsel for the applicants would submit that the applicant is innocent person and has been falsely implicated in the present case on the basis of the statement of the co-accused person.
Learned counsel for the State vehemently opposed the anticipatory bail application and would submit that the investigation is underway; that, charge sheet has not been filed so far. He would further submit that as per the averments of counter affidavit filed on behalf of the Investigating Officer the investigation could not be completed due to unavailability of the present applicant/accused.
Having considered the entirety of facts, the applicant does not deserve anticipatory bail at this stage. The anticipatory bail application is, accordingly, rejected. Interim order dated 25.04.2022 is hereby vacated.
