Subedar Ram vs U.P.S.R.T.C. and Others

Sudhir Agarwal, J.—The writ petition is directed against the order dated 24th April, 2008 passed by Assistant Regional Manager, U.P.S.R.T.C. Chhutmulpur, informing Petitioner that since caste certificate issued to the Petitioner on 18th October, 2003 by Tehsildar, Sadar, Ghazipur has been cancelled by order dated 16th January, 2008 hence the process regarding his appointment is being deferred.

It is pointed out that the Tehsildar, Sadar, Ghazipur order dated 16th January, 2008 was challenged by the Petitioner in writ petition No. 5409 of 2008 which was allowed by Division Bench of this Court vide judgment dated 18th August, 2008 and Tehsildar''s order dated 16th January, 2008 has been set aside, pursuant thereto Tehsildar, Sadar has also issued a letter dated 15th September, 2008 communicating to the Petitioner that cancellation order dated 16th January, 2008 stands revoked.

In this view of the matter since the very basis of issuance of letter dated 24th April, 2008 has disappeared, the impugned order cannot sustain.

The writ petition is allowed. The impugned order dated 24th April, 2008 (Annexure No. 1 to the writ petition) is hereby quashed.

The Respondents are directed to proceed in the matter of appointment of Petitioner on the post of Conductor and pass appropriate order in accordance with law. This exercise shall be completed by the competent authority within three months from the date of production of a certified copy of this order before him.
