Judgment

This is an application of the petitioner under Section 439 of Cr.P.C. in connection with Koraput Town P.S. Case No. 233 of 2023 corresponding to G.R. Case No. 707 of 2023 pending in the Court of the learned S.D.J.M., Koraput registered for commission of offence punishable under Sections 392, 34 of IPC.
This bail application has been listed before me as BLAPL No. 12590 of 2023 filed by the co-accused persons namely Narendra Macha, Hemanta Nag and Abhi Harijan had been disposed of by me on 09.11.2023.
The prayer for bail of the petitioner has been rejected on 18.11.2023 by the learned Addl. Sessions Judge, Koraput as the investigation was in progress and the petitioner has one criminal antecedent namely Jeypore P.S. Case No. 267 of 2023 under Section 392/34 of IPC.
Ms. Afreen, learned counsel for the petitioner submits that the petitioner does not want to press this application without citing any reason for doing so.
The BLAPL is dismissed as not pressed.
This order is passed at 12.16 P.M. today i.e. 20.05.2024.
Since no reason has been cited for withdrawing the bail application, a report be called for from the learned S.D.J.M., Koraput regarding present status of the case and the status of the petitioner in G.R. Case No. 707 of 2023.
List this case on 19.06.2024 awaiting the status report.
