Judgment
THE case in brief is that the respondent was appointed by the appellants as P.E.T. vide their letter No. 48 dated 7.11.1993. He had deposited a sum of Rs. 10,000/- towards security deposit and the amount was refundable if he resigns from the said post within two years. Due to non-payment of salary he resigned from the post but the appellant did not refund the security deposit amount though the respondent asked him several times. THE Collector, Phulbani on respondent''s request directed the appellant to refund the money and accordingly he issued an account payee cheque of Rs. 5,000/-. THE said cheque was dishonoured by the Bank for insufficient of funds.
THEREFORE, the respondent filed C.D. case in the District Forum, Phulbani. The District Forum directed the appellant to refund the money with interest. On perusal of records we find that the District Forum has passed the well reasoned order. We do not want to interfere with the order of the lower Court. We direct the appellant to refund the deposited amount of Rs. 10,000/- with 12% interest from the date of order of the District Forum till payment. As to no cost. Copy of the order be sent to the respondent. Appeal dismissed.
