Heard Mr. A. Tripathy, learned counsel appearing for the petitioner.
The petitioner has filed this writ petition seeking to quash his order of transfer dated 31.01.2024 as well as the order dated 05. 02.2024 passed by the Central Administrative Tribunal, Cuttack Bench, Cuttack, in O.A. No.58 of 2024 and further to issue direction to the opposite party-authority to consider the case of the petitioner like others to retain in Odisha.
As it appears, challenging the order of transfer dated 31. 01.2024, the petitioner approached the Tribunal by filing O.A. No.58 of 2024 and the Tribunal, vide order dated 05.02.2024, disposed of the said O.A. with an observation that in view of decision of the apex Court in Director of School Education v. O. Karuppa Thevan, 1994 Supp.(2) SCC 666, the Tribunal impressed the authority concerned to defer the transfer and posting of the petitioner in his promotional post to Kolkata, if there is no other impediment, till the end of February, 2024. Now the said period has been over.
In any case, learned counsel for the petitioner contended that though the grievance of the petitioner has been recommended by the authority, the same is pending for consideration. Since the grievance of the petitioner has been recommended, it is open to the petitioner to pursue his remedy before the authority and, as such, this Court is not inclined to interfere with the order dated 05. 02.2024 passed by the Tribunal in O.A. No.58 of 2024.
With the above observation, the writ petition stands disposed of.
