Judgment
Mohammed Nias. C.P.,J
This writ petition is filed with the following prayers:-
“(i) issue a writ of mandamus or any other appropriate writ, order or direction directing the 1st respondent to constitute the 2nd respondent by appointing members as expeditiously as possible, at any rate, within a time limit to be fixed by this Honourable Court.
(ii)Issue a writ of mandamus or any other appropriate writ, order or direction directing the 2nd and 3rd respondents to consider Exhibit P3 application and grant the No Objection Certificate alongwith the recommendation of Exhibit P4 and issue mining permit for excavating sand from the dry land properties in Sy.Nos.115/11 and 115/12 of Ayarkunnam Village, Kottayam Taluk as expeditiously as possible at any rate within a time limit to be fixed by this Honourable Court. And;
(iii) Such other relief and orders as may prayed for or deemed fit and proper in the facts and circumstances of the case.”
A statement has been filed by the third respondent, wherein it is stated that the Kerala Minor Mineral Concession Rules, 2015 is in place and permission can be granted only in terms of the said Rules.
Reserving the liberty of the petitioner to make an appropriate application under the said Rules, this writ petition is closed.
