Judgment

In this petition, the petitioner seeks the following reliefs:
“A. Issue a writ of in the nature of mandamus direction to the respondent No.3 authority to permit the petitioner for appearing final semester i.e. 6th semester examination commencing on 21.04.2025 in the interest of justice and equity.
B. It is further submitted that the petitioner prays this Hon’ble court to issue a direction to the respondent No.3 authority to declare the result of the 5th and 6th semester in the interest of justice and equity.
C. Pass any other order as this Hon’ble Court deems fits on the facts and circumstances of the case.”
Heard learned counsel for the petitioner, learned counsel for respondent No.1, and learned Senior counsel for respondent Nos.2 and 3 and perused the material on record.
Learned Senior counsel for respondent Nos.2 and 3, on instructions submits that respondent Nos.2 and 3 would permit the petitioner to take up the ensuing 6th semester examination scheduled to be commenced from 21.04.2025, subject to the condition that the petitioner would repeat/once again take up 5th semester examinations/supplementary examination, as and when they are announced by respondent Nos.2 and 3.
Learned counsel for the petitioner submits that the petition may be disposed of in terms of the submissions made by learned Senior counsel for respondent Nos.2 and 3.
In view of the aforesaid facts and circumstances and joint submissions made by learned Senior counsel for respondent Nos.2 and 3, the petition stands disposed of permitting the petitioner to take up the ensuing 6th semester examinations commencing from 21.04.2025, subject to the condition that the petitioner shall repeat/once again take up 5th semester examination/supplementary examination, as and when they are announced by respondent Nos.2 and 3. Liberty is reserved in favour of the petitioner to make additional request to respondent Nos.2 and 3, who shall consider the same and proceed further in the matter, in accordance with law.
Subject to the aforesaid observations and directions, the petition stands disposed of.
