Judgment

This is an application seeking temporary injunction moved by the plaintiffrespondents to restrain the appellants, their official, servants, agents etc. including the Aligarh Development Authority, Aligarh from raising any construction over the suit property by altering its nature or character in any manner.
Shri R.B. Pradhan, learned Standing Counsel appearing for the appellants prays for and is allowed time till 25th of June, 2009 to file a counter affidavit. Shri Ram Kaushik appearing for respondent no. 8, Nagar Nigam, Aligarh may also file counter affidavit within the same period.
List/put up on 6th of July, 2009.
Shri R.B. Pradhan appearing for the appellants has made a statement that till 6th of July, 2009, the appellants shall not raise any new construction over the land in dispute.
In view the undertaking given on behalf of appellants, there is hardly any necessity to pass any order on the injunction application today and the same shall be considered on the next date after exchange of affidavits between the parties.
It is being made clear that undertaking given by Shri Pradhan, learned Standing Counsel is only in respect of any new construction over the land in dispute.
