Heard Sri Lalit Shukla, learned Additional Chief Standing Counsel for the State and Sri Kuldeep Bajpai, learned counsel for the opposite party.
In compliance of this Court''s earlier order, the opposite partyDevi Shankar Mishra is present in person before this Court. He has tendered his unconditional apology for having written the letter dated 14.07.2000 on the basis of which the instant reference has been registered.
Opposite partyDevi Shankar Mishra has also filed an affidavit stating therein the circumstances under which the letter in question had been sent by him to the Hon''ble High Court.
In view of the fact that the opposite party has tendered unconditional apology before this Court for his conduct and there is material on record to show that at the time when the letter in question had been sent by him to the Hon''ble High Court, the opposite party was not in a sound mental state, the instant reference is dismissed. Notice issued to the opposite party is hereby discharged. The reference is consigned to record.
